WHO HANDLES VIOLATIONS OF

THE STUDENT CONDUCT CODE

 

Resident Directors on the Gorham Campus

  RDs are not conduct officers.  They handle violations that occur inside residence halls.  They can only offer to resolve a violation with a student who voluntarily admits violating a particular policy and voluntarily accepts an agreed upon sanction(s).

  The types of violations RDs handle are:

  ·        Contract Violations such as:  Noise, Candles, Hall Sports, Lounge Furniture, Pets, Room Changes,      Smoking, Trash Removal, Wall Hangings, or Waterbeds.

·        Any First Alcohol Violation resulting in a First Strike or Second Strike.

·        Any Second Alcohol Violation resulting in a Second Strike.

·        Any violation that would place a student on Disciplinary Warning or Housing Contract Probation for the remainder of a year up to one calendar year.

  Staff Associate for Student Conduct and Programming

  Like the RDs the Staff Associate (the graduate assistant in Community Standards) resolves cases with students by voluntary agreement.  The SA handles violations that occur

a.      outside of residence halls of the same or similar level of severity as the RDs do for violations inside the halls. 

b.      inside residence halls (except Dickey/Wood), if called upon to do so.

Conduct Officer

  The Conduct Officer hears the following types of cases.  Violations that occur

a.      on campus (Portland, Gorham Lewiston/Auburn) including inside of residence halls where the sanction is up to and including removal from housing.

b.      due to a student failing to complete an educational sanction.

c.       due to a student choosing not to resolve with an RD/SA or refusing to meet an RD/SA.

Assistant to the Vice President for Community Standards

  The Assistant to the Vice President oversees the entire conduct process.  In this capacity the Assistant may hear cases that could have been heard by any of the people above.  In addition, the Assistant hear the following types of case:

  a.      all violations that may or do result in sanctions of Deferred Suspension from the University, Suspension or Dismissal from the University at occur on campus (Portland, Gorham Lewiston/Auburn) including inside of residence halls.

b.      All violations that occur off campus (any place on the earth) that may or do result in sanctions of Deferred Suspension from the University, Suspension or Dismissal from the University, if the following test is met:

1.      the University can demonstrate a “clear and distinct interest”.

2.      the conduct “seriously  threatens”

a.      any “educational process”.

b.      any “legitimate function of the University”.

c.       “the health or safety of any member of the academic community”.
