APPEAL HEARINGS
General Procedures Used During An Appeal Hearing.
1. Written Appeal:
-
When
is the written appeal due? - A written appeal must be received by the
Officer within seven calendar days after the Student Charged has received
notice of the sanction'(s).
b. What do I include in the written appeal? - Such appeal shall be
written by the Student
charged
appealing and shall state the issue'(s) being appealed and provide a detailed
rationale. The written appeal shall also request a review by the
Committee.
c. Where do I deliver the written appeal? - The written appeal
could be delivered to Office
of Community

2. Who is going to hear my case?- Three to seven
students who are randomly chosen from the
Student Conduct Committee
(SCC) with the assistance of a Faculty /Administrative Advisor will hear
your case.
3. What
is the role of an Advisor to the Student? - If any party in the appeal
hearing (e.g. student
charged, conduct office, or complainant) has an Advisor, that person's
role is to assist and support
that individual. The Advisor may actively speak with the individual during
the hearing, but may not
speak to the Committee or ask questions during the hearing. After the
presentation of all evidence
to the Committee, the Advisor, in place of the individual, may present arguments
to the Committee
on the applicability of this Code or the interpretation of any sections herein.

5. What can the Student Conduct Committee (SCC) do? - The
Student Conduct Committee
is a panel of students that hears appeals from other students found in
violation of the Student
Conduct
Code by the Student Conduct Officer. The appellant/student can appeal the
finding of
Conduct
Officer, the sanctions imposed, or both the finding and the sanctions. The
Committee
has
both the original and appellate jurisdictions, meaning the Committee can hear
cases referred
directly
to it and appeals of a decision. The outcome of an appeal may result in a
higher, lower,
the
same, or no sanction at all being imposed.
6. What will happen if the Student Conduct Committee (SCC) finds
me responsible for a violation of the Student Conduct Code? - If the
Student Conduct Committee believes you have violated campus policy, a sanction
will be imposed. In deciding your appropriate sanction, the board will
consider such factors as any current sanctions you are completing.
7. How will I find out what the Student Conduct Committee decided?
- After the hearing, the Student Conduct Committee will send you a
letter. The letter will explain if the board members found you not
responsible or responsible for the charge(s) brought against you. If the
board members found you responsible, your sanction will be explained
along with a rationale for the sanction.
8. What will my hearing be like? Will it be like a trial? -
Your hearing will be nothing like a trial. No one will be cross-examined
or interrogated. Everyone will sit around a conference table in an
informal atmosphere. Board members and students are permitted to dress
casually. Although informal, there is structure and order followed in
every hearing. The administrator presenting charges, the accused student
and witnesses will be given an opportunity to make oral statements before
questions are asked.
