Sample Bequest Wording

"I instruct that all of my charitable gifts, bequests, and devises shall be made, to the extent possible, from property that constitutes income in respect of a decedent as that term is defined under the U.S. income tax laws."

Without this language, the estate will only be able to claim an estate tax charitable deduction for its charitable bequests, but not an income tax charitable deduction.

Client wishes to give a percentage of estate

I give to the University of Southern Maine Foundation, incorporated under the laws of the State of Maine, __ percent ( __%) of my estate, for its general purposes (or describe the specific purpose, if desired.)

Client wishes to give a specific dollar amount

I give to the University of Southern Maine Foundation, incorporated under the laws of the State of Maine, the sum of __________ ($_______), for its general purposes, or describe the specific purpose, if desired.)

Client wishes to make a contingency bequest

I give the residue of the property, real and personal, and wherever situate, owned by me at my death to my above named beneficiaries, if they survive me. I any of the above named beneficiaries does not survive me, I give his/her share of my residuary estate to the University of Southern Maine Foundation, incorporated under the laws of the State of Maine, for its general purposes (or describe the specific purpose, if desired.)
